Illegal Shirts – Terms of Service Last Updated: July 23, 2025

1. Who We Are These Terms of Service ("Terms") are a legally binding agreement between you and HDCX Enterprises LLC, a Kentucky limited liability company ("Illegal," "we," "us," or "our"), covering your access to and purchases from our websites, mobile experiences, and related services—including any sub‑brands that link to these Terms (collectively, the "Site").

By accessing the Site or by clicking "Place Order" (or a similar button), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

2. Eligibility You must be at least 18 years old (or the age of majority where you live) to make purchases. If you are under 18, a parent or legal guardian must complete the transaction and supervise your use.

3. Account Security If you create an account, you are responsible for keeping your username and password confidential and for all activities that occur under your account. Notify us immediately of any unauthorized use.

4. Orders & Made‑to‑Order Production (a) Order Acceptance. Your order is an offer to purchase; we may reject or cancel any order (for example, for suspected fraud, incorrect pricing, or policy violations) before we ship. If we cancel after charging you, we will refund the original payment method.

(b) Made‑to‑Order. Most products are printed or sewn when ordered. Production times shown at checkout are estimates, not guarantees.

(c) Quantity Limits. We may limit or cancel quantities per person, per household, or per order.

5. Pricing, Taxes, and Payment Prices are shown in U.S. dollars and, unless stated, exclude taxes, shipping, and any other fees. The full amount—including taxes and shipping—is displayed at checkout before you finalize payment. By placing an order, you authorize us to charge your selected payment method. If we discover a pricing or description error, we may cancel or contact you for instructions before shipping.

6. Shipping; Risk of Loss Shipping options and estimated delivery windows appear at checkout and in our Shipping Policy. Unless we state otherwise in writing, title and risk of loss pass to you when the carrier first scans the package. If you want signature‑required or insured delivery, choose it at checkout. Once a package is marked "delivered," any loss or theft is your responsibility; however, we will assist you in filing a carrier claim.

7. Returns – Defective Items Only All sales are final except for items that arrive damaged or defective. Please follow our Defective Item Replacement & Refund Policy for eligibility requirements, claim steps, and timelines. That policy is incorporated by reference into these Terms.

8. Intellectual Property & Site License All content on the Site (including text, graphics, logos, images, software, and designs) is owned by Illegal or our licensors and is protected by copyright, trademark, and other laws. We grant you a limited, revocable, non‑transferable license to access and use the Site for personal, noncommercial shopping. Any other use—including scraping, data mining, reverse engineering, or commercial exploitation—is prohibited without prior written consent.

9. User Content & Custom Artwork If you submit designs, text, images, feedback, reviews, or other content ("User Content"), you represent that you own or control all necessary rights and that your User Content does not infringe, violate, or misappropriate any third‑party rights or laws. You grant Illegal a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, publicly display, translate, distribute, print, and create derivative works from your User Content for the purpose of fulfilling your orders, operating the Site, and marketing our products (including mock‑ups and social media posts). We may refuse or remove User Content at any time.

You agree to indemnify and hold Illegal harmless from any claim arising out of your User Content.

10. Copyright / DMCA Policy Illegal respects intellectual‑property rights. If you believe material on the Site infringes your copyright, please send a DMCA notice to our Designated Agent

Your notice must include: (i) your signature; (ii) identification of the copyrighted work; (iii) identification of the material claimed to be infringing; (iv) your contact information; (v) a statement of good‑faith belief; and (vi) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act. We may remove or disable access to the material and notify the alleged infringer, who may submit a counter‑notice as allowed by law. We may terminate repeat infringers.

11. Disclaimer of Warranties EXCEPT AS EXPRESSLY SET OUT IN THESE TERMS OR REQUIRED BY LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, OR TITLE. SOME JURISDICTIONS MAY NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, SO SOME DISCLAIMERS MAY NOT APPLY TO YOU.

12. Limitation of Liability TO THE FULLEST EXTENT PERMITTED BY LAW, ILLEGAL (AND ITS OFFICERS, MANAGERS, EMPLOYEES, AGENTS, AND AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) USD $100 OR (B) THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR INJURY WHERE SUCH LIMITS ARE NOT LAWFUL, NOR DOES IT LIMIT ANY NON‑WAIVABLE STATUTORY RIGHTS YOU MAY HAVE.

13. Indemnification You agree to defend, indemnify, and hold Illegal, its affiliates, and their respective officers, managers, employees, and agents harmless from any claim, demand, loss, or damages (including attorneys’ fees) arising out of your (a) breach of these Terms; (b) User Content; or (c) violation of any law or the rights of a third party.

14. Governing Law & Dispute Resolution These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict‑of‑law rules. Any dispute arising out of or relating to these Terms, the Site, or products will be resolved exclusively in the state or federal courts located in [County], Kentucky, and you consent to personal jurisdiction and venue there. Nothing limits either party’s right to seek equitable relief in any court of competent jurisdiction.

15. Changes to These Terms We may update these Terms. The "Last Updated" date will change when we do. For material changes, we will notify registered users by e‑mail or a prominent Site notice at least ten (10) days before the new Terms take effect. Continued use of the Site after the effective date constitutes acceptance.

16. Termination We may suspend or terminate your account or access to the Site at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

17. Consumer Rights & Severability Nothing in these Terms limits any rights you may have under applicable consumer‑protection laws, including the Kentucky Consumer Protection Act. If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.

We encourage you to give us an opportunity to resolve your concern first.

These Terms constitute the entire agreement between you and Illegal regarding the Site and supersede all prior or contemporaneous communications.
